NATIONWIDE BAN OF CHEMICAL ABORTION PILLS

The Alliance for Hippocratic Medicine, et al are challenging the FDA’s approval of the chemical abortion pill regimen; a move which, if successful, could mean a nationwide ban of chemical abortion.

What Does This Mean?

If this case is successful; it means that chemical abortions all over America will stop, even in states where abortion is legal. Considering that chemical abortions account for more than half of all abortions nationwide, this case stands to immediately save tens of thousands of lives!



What Exactly IS The Challenge?

The plaintiffs, represented by The Alliance Defending Freedom, argue that the FDA unlawfully fast-tracked the approval and never studied the safety of the drugs under the labeled condition for use. The FDA characterized pregnancy as an “illness” and never studied the safety of the drugs for use in abortions. The FDA’s approval of mifepristone and misoprostol’s use for abortions should be reversed, according to the complaint.

“To date, the FDA’s review, approval, and deregulation of chemical abortion drugs has spanned three decades, correlated with four U.S. presidential elections, and encompassed six discrete agency actions. Plaintiffs challenge these six FDA actions and ask that the Court hold them unlawful, set them aside, and vacate them.” Case no. 2:22-cv-00223-Z, Complaint, p. 2

Georgia’s Attorney General Chris Carr joined with 21 other state Attorneys General in filing an amicus brief supporting the Plaintiffs.

What Happens Next?

If Judge Kacsmaryk rules in our favor and reverses the FDA’s approval of the chemical abortion pill regimen; the case may be appealed to the 5th Circuit Court of Appeals, and ultimately to the Supreme Court of the United States.



In the meantime, the chemical abortion pill regimen would be pulled from the market and the FDA would have to decide to restart the approval process - which could take years. This one ruling would amount to a NATIONWIDE BAN ON CHEMICAL ABORTION.

With Roe v. Wade’s apparent demise imminent and Georgia’s Heartbeat Bill weeks from going into effect, it has never been more important to pass policy that builds up a state prepared for a post-Roe culture. We are so proud to announce that Governor Kemp has signed GLA’s flagship legislation, Betsy’s Law , which allows nonprofits to provide free maternity supportive housing to homeless pregnant women and their minor children. Betsy’s Law, named after the child our Leadership Director, Elizabeth Reed , courageously placed for adoption when she was homeless and pregnant at age 15, will save lives immediately and provide the hope that thousands of women will need with abortion access gone in Georgia.
