I apologize for the early post, but I’ve spent the last 28 hours in a whirlwind surrounding the oral arguments of Georgia’s Heartbeat Bill in the 11th Circuit Court of Appeals and I couldn’t pull myself away from media interviews and grassroots training to email you until now.
Our legal team was listening in on the hearing all Friday morning, then we immediately went in to debrief meetings with our team and the author of the law itself, Rep. Ed Setzler, to ensure that everyone was in agreement on the historic developments.
We all agree. Everything has changed.
As I told the folks at 11 Alive News, Georgia Recorder, and others: the Court made it clear that they absolutely agree with Rep. Setzler and Georgia Life Alliance that affirming the personhood of preborn babies and supporting families with unborn dependent tax deductions and child support for babies with beating hearts is clearly constitutional.
What’s more, we heard the attorney for the abortion industry make an unprecedented concession: affirmed that Roe v. Wade is no longer a matter of settled law. The ability for Georgia to enforce our heartbeat abortion ban in conjunction with our personhood language will be determined by how the Supreme Court rules on Mississippi’s 15-week abortion law in June of next year.
Our legal team believes that the 11th Circuit Court of Appeals will likely put their Heartbeat Bill decision on hold until after the Supreme Court rules on Mississippi’s “Dobbs v. Jackson Women’s Health” case. They will hear that case in December of this year then issue a decision in June of next year.
But, before then, there is a real chance they will uphold all of our personhood language, the child support, tax deduction, and remainder of the Heartbeat Bill even by the end of this year.
Georgia has, once again, demonstrated that our state is the best positioned to actually implement a law that eliminates nearly all abortion and recognize the personhood of babies in the womb.

While we await the 11th Circuit to decide on Georgia’s Heartbeat Bill, we will be back at work speaking around the state about the personhood of the unborn and the importance of preparing for a day when our Heartbeat Bill is in effect - possibly as soon as next June.
We are the only pro-life group in Georgia touring the state to help educate communities, equip churches, defend pregnancy centers, protect the Heartbeat Bill, and ensure the pro-life majority at the Capitol continues to build a culture of life.
We need your prayers, your support, and your passion to make Georgia ready to be a Post-Roe state.
Now that the Heartbeat Bill is in the hands of the 11th Circuit, can you commit to praying for the Judges on the Court? Can you commit to asking your Pastor to bring GLA in to speak about the Heartbeat Bill and what it means for our communities? Can you commit to giving financially to helping us continue growing the pro-life culture in our state?
The reality is, we have never been closer than we are right now to finally putting the last nail in the coffin of Roe and protecting life in our state. But if we get content and ease off the gas, the abortion industry will regroup and push back.
That’s why we are celebrating this victory, but getting back to work harder than ever. We aren’t daunted by being the only pro-life group in Georgia working with our lawmakers to protect all life - because we know that you and our Heavenly Father are on our side.
And I’d pick this team over any other, any day of the week.
